Terms & Conditions

1. Agreement to Terms

By registering for, attending, speaking at, sponsoring, exhibiting at, volunteering at, or otherwise participating in the Flourishing Learners Conference 2027 (“the Conference”), you agree to be bound by these Terms & Conditions.

These Terms & Conditions form a legally binding agreement between you and Melbourne Archdiocese Catholic Schools Ltd (“MACS”).

These Terms apply to all participants, including but not limited to:

• Attendees (MACS and non-MACS)
• Presenters and speakers
• Sponsors, partners, exhibitors and vendors
• MACS staff, contractors and volunteers
• Any other persons attending or participating in the Conference in any capacity.

MACS reserves the right to amend these Terms & Conditions from time to time. Any material updates will be published on the Conference website. Continued participation constitutes acceptance of the amended Terms.

2. Compliance, Health and Safety

As a condition of participation, all participants must:

• Comply with all applicable laws and regulations;
• Follow all reasonable directions issued by MACS, venue staff, security personnel or emergency services;
• Comply with all health, safety and venue requirements in place at the time of the Conference, including any Government or public health directions.

MACS may refuse entry to, or remove from the Conference, any person who fails to comply with these requirements, without refund.

3. Registration and Payment

3.1 Payment

• All registration fees must be paid in full via credit card using the Conference registration system.
• A registration is not confirmed until full payment has been received.
• Registration fees are determined by the date payment is received, not the date the registration form is submitted.

3.2 Early Bird Registration

Where early bird pricing applies, the discounted rate is available only if full payment is received by the advertised deadline. Unpaid registrations will automatically revert to the standard rate.

3.3 Single Day Registration

Delegates may purchase only one (1) single-day registration. Attendance on multiple days requires a multi-day or full Conference registration.

3.4 Late Registration

Registrations received within four (4) weeks of the Conference commencement date may not be guaranteed access to Conference materials or social functions. No reduction in fees will apply where inclusions are unavailable.

3.5 Transfer of Registration

Fully paid registrations may be transferred to another person from the same organisation, subject to approval from MACS. Transfer requests must be submitted in writing by the advertised transfer deadline and include full delegate details.

4. Cancellations, Refunds and Non-Attendance

4.1 Delegate Cancellations

• Cancellations must be submitted in writing to flourishing@macs.vic.edu.au.
• Cancellations received four (4) weeks or more prior to the Conference commencement date may be eligible for a refund, less an Events Air Pay powered by Stripe administrative fee of 1.9%.
• Cancellations received after this date are not eligible for a refund.

4.2 Optional Items

Cancellations of optional items (such as social functions) received four (4) weeks or more prior to the Conference may be eligible for a refund of the cancelled item only.

4.3 Non-Attendance

No refunds will be provided for non-attendance or partial attendance.

4.4 Refund Processing

Approved refunds will be processed within thirty (30) days following the conclusion of the Conference.

Personal circumstances (including travel issues or visa refusal) do not override these cancellation terms.

5. Changes or Cancellation by MACS

MACS reserves the right to:

• Modify the Conference program, speakers, content, venue, timing or delivery format; or
• Cancel or postpone the Conference due to circumstances beyond its reasonable control, including natural disasters, public health emergencies, Government restrictions or safety concerns.

Where the Conference is cancelled or postponed, MACS’ liability is limited only to a refund of registration fees paid.

MACS is not responsible for travel, accommodation or other associated costs or expenses.

Where postponed, registrations may be transferred to the rescheduled event under the same Terms and Conditions.

6. Code of Conduct and Behaviour

All participants must comply with the Conference Code of Conduct, as published on the Conference website at (www.flourishinglearners.com.au).

MACS may, at its discretion:

• Refuse entry;
• Remove a participant; and/or
• Engage venue security or relevant authorities

where behaviour is deemed inappropriate, unsafe, offensive, disruptive or non-compliant. No refunds will be provided in these circumstances.

7. Child Safety

All participants must always comply with MACS’ child safety policies and applicable child safety legislation. Any concerns relating to child safety must be reported immediately to the conference organisers.

8. Privacy

MACS complies with the Privacy Act 1988 (Cth) and applicable privacy legislation.

Personal information collected through registration is used to:

• Process and manage registrations;
• Plan and deliver the Conference;
• Communicate essential Conference information;
• Compile evaluation and reporting data; and
• Inform future MACS professional learning activities.

MACS’ Privacy Policy applies and is available on the MACS website.

8.1 Disclosure

Delegate information (such as name, role and organisation) may be disclosed to Conference sponsors or exhibitors only where explicit consent is provided or where required or permitted by law.

8.2 Conference App

Delegate details may be uploaded to the Conference app. Delegates are responsible for managing their own privacy settings and device requirements to ensure access and use is permitted.

9. Photography, Audio and Video Recording

The Conference may be photographed, filmed and recorded.

By attending, participants grant MACS a royalty free, perpetual licence to capture, use, reproduce, edit and distribute their image, voice and likeness for reporting, professional learning and promotional purposes across all media formats, including live streaming and on demand access.

Participants who do not consent must notify MACS in writing prior to the Conference or indicate this at the time of registration.

10. Intellectual Property

10.1 MACS and Third Party Content

All intellectual property rights in Conference materials, branding and content remain the property of MACS or the relevant third party owner.

10.2 Presenter Content

Presenters:

• Retain ownership of their materials; and
• Grant MACS a non exclusive, royalty free, perpetual licence to record, reproduce, adapt, distribute and communicate their presentations and related materials for professional learning, marketing and archival purposes, unless otherwise agreed in writing.

Presenters warrant that their materials do not infringe third party rights and indemnify MACS against any claim arising from their content.

11. Sponsors, Exhibitors and Vendors

Sponsors, exhibitors and vendors are responsible for:

• Their materials, displays and personnel;
• Compliance with all venue requirements and applicable laws; and
• Any loss or damage arising from their participation.

MACS does not endorse sponsor or exhibitor products or services.

12. Insurance and Liability

Registration fees do not include insurance. Participants attend at their own risk and are responsible for arranging appropriate insurance coverage.

To the maximum extent permitted by law:

• MACS excludes liability for indirect or consequential loss; and
• MACS’ total liability is limited to the registration fee paid.

13. Non-MACS Participation

Attendance by non-MACS schools, organisations or individuals does not imply endorsement, partnership or oversight by MACS.

14. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
